In their Vaugh index targeting undisclosed materials, we have identified the following documents and intend to further investigate. A PDF file from May 2022, titled 'Analysis of Ethereum 2.0 Based on Howey Testing', prepared by SEC staff. A February 2023 email titled 'Reply on whether Ethereum is a security'. A PDF file from April 2023, titled '2- Ethereum 2.0', which may have been a memorandum received by the commissioners before voting to authorize an investigation into Ethereum 2.0. An email from August 2023 titled 'Timing for Ethereum Discussion'. Two emails from February 2024, titled 'FW Spot Ethereum - Securities or Non Securities' and' Ethereum - Securities or Non Securities'.
