The United States Commodity Futures Trading Commission (CFTC) has issued a Notice of Proposed Rules (NPRM) to publicly solicit opinions on revisions to Sections 37, 38, 39 and Sections 1.52, 1.55 of the CFTC Regulations. The solicitation period for opinions is 60 days after publication in the Federal Register. This revision aims to address conflicts of interest arising from the increased association between regulated institutions such as derivative clearing organizations (DCOs), designated contract markets (DCMs), swap execution facilities (SEFs), futures commission merchants (FCMs), and market makers. CFTC Chairman Michael S. Selig stated that the new regulations will establish a principle based regulatory framework for vertically integrated market structures, supporting innovation in the US derivatives market while maintaining market integrity.
