Hyperliquid Policy Center submits a friend of the court opinion supporting the rejection of CME v. CFTC case

--

The Hyperliquid Policy Center has submitted a friend of the court opinion, urging the United States District Court for the District of Columbia to dismiss CME's lawsuit against CFTC. The opinion letter was submitted on behalf of Elizabeth Prelogar, former United States Deputy Attorney General at Cooley Law Firm. The Hyperliquid Policy Center argues that CME cannot prove that CFTC's decision caused actual harm, does not have the litigation status required by Article 3 of the Constitution, and CME's interests in preventing competitors from launching new products are not protected by the Commodity Exchange Act.
