The US Sixth Circuit Court of Appeals ruled that Ohio and Tennessee can enforce gambling laws against Kalshi

On September 25th, the US Sixth Circuit Court of Appeals ruled that Ohio and Tennessee can enforce state gambling laws on sports contracts for predictive market platform Kalshi. The court upheld the decision of a federal judge in Ohio to refuse to block state regulatory enforcement and revoked the protective order granted to Kalshi by Tennessee. The court held that Kalshi failed to prove that the sports contract falls under the exclusive jurisdiction of the Commodity Futures Trading Commission (CFTC) as a swap contract, and that federal law does not exclude the application of state gambling laws. The ruling is in the stage of temporary injunction review, and both states can enforce relevant laws during the duration of the case.
