[US Court Rejects Application for Temporary Injunction to Block CFTC Approval of Individual Stock Perpetual Derivatives] A judge in the US District Court for the Southern District of New York rejected a petition for a temporary restraining order from the Capital Markets Alliance Association, which sought to halt the Commodity Futures Trading Commission's (CFTC) approval of individual stock perpetual derivatives. The court held that the plaintiff failed to demonstrate that failure to seek emergency relief would result in imminent and irreparable harm to its members. The judge stated that the plaintiff's argument that the CFTC lacks the authority to approve the products as securities futures is likely to prevail, as the contracts appear to meet the definition of swaps regulated by the SEC. The CFTC must respond to the preliminary injunction application by November 6, and the plaintiff must respond by November 10. These deadlines may be adjusted by the judge presiding over the case.
