The rules will take effect on October 16, 2026. Initially, products linked to overseas cryptocurrency ETFs, such as depositary receipts, will not be permitted. Thai brokers are still prohibited from assisting retail investors in investing in overseas cryptocurrency ETFs, though institutional investors and ultra-high-net-worth individuals are not subject to this restriction. Mutual funds and private funds are allowed to invest in cryptocurrency ETFs established in Thailand. Related ETFs must adopt a passive investment strategy, tracking the price of the underlying cryptocurrency assets, and ensure that the average net exposure to a single cryptocurrency reaches at least 80% of the net asset value during each fiscal year.
