New Jersey officials apply to US Supreme Court to hear Kalshi sports contract case

Jennifer Davenport, the Attorney General of New Jersey, and Mary Jo Flaherty, the Acting Director of the State Gaming Enforcement Department, have submitted a request for a subpoena to the United States Supreme Court to hear a case regarding enforcement measures taken by the state against the sports event contract provided by the predictive market platform Kalshi. The application requests the Supreme Court to rule on whether predictive market companies are still violating state laws while complying with the regulations of the U.S. Commodity Futures Trading Commission (CFTC), and whether the Dodd Frank Act excludes state governments from regulating sports betting. Kalshi spokesperson Dani Lever stated that the company does not agree with New Jersey's appeal to the Supreme Court and stated that Kalshi cannot accept separate regulation by 50 regulatory agencies.
